TROY, Ohio — A Miami County jury on Tuesday found former “American Idol” contestant Caleb Flynn guilty on all counts in the February shooting death of his wife, Ashley Flynn, delivering its verdict after about two hours of deliberation.
Flynn, 40, was convicted of nine counts: one count of aggravated murder, three counts of murder, two counts of felonious assault and three counts of tampering with evidence, with firearm specifications attached to seven of the charges. Two misdemeanor counts of intimidation had been dismissed earlier in the week on a motion from prosecutors.
Flynn wept as Judge Jeannine Pratt read the verdict in Miami County Common Pleas Court, following an eight-day trial and testimony from roughly 40 prosecution witnesses.
Prosecutors argued Flynn shot his 37-year-old wife twice in the back of the head as she slept in their Tipp City home on February 16, then staged the scene to look like a home invasion before calling 911 to report an intruder — all so he could start a new life with his mistress, 24-year-old Alleigha Botner, a former intern at his church.
The trial centered on the affair and the roughly 107,000 text messages the pair exchanged. Botner testified across two days, telling jurors about messages in which Flynn wrote of wanting his wife dead — including “That makes two of us” in response to her “I want to kill her, Caleb,” and a message sent the night before the killing: “I choose you. I’m free. Actions will come tomorrow.” Asked how she feels about Flynn today, Botner testified: “I hate him.” She added: “I believe that he murdered his wife.”
An FBI agent testified she found no pry, kick or ram marks on the outside of the supposedly forced door — only gouge marks on the inside of the frame. The gun was never recovered.
The defense argued the case was entirely circumstantial, with no eyewitness, no confession and no physical evidence connecting Flynn to the shooting, and said his “ugly, hurtful” messages to Botner were attempts to appease her. Flynn’s attorney said the defense was disappointed with the verdict and expects to appeal.
Flynn is scheduled to be sentenced on October 5. He faces life in prison without the possibility of parole.
